Section 65
Work, Duties and Powers of Public Procurement Monitoring Office
(1) In addition to the provision elsewhere in this Act, the work, duties and powers of the Public Procurement Monitoring Office shall be as follows:-
(a) Recommending to the Government of Nepal to improve the procurement policy or prevailing law,
(b) Issuing necessary guidelines, procedures and technical guidance on procurement methods such as turn key, EPC, structural or unit rate agreement, management agreement,
(c) Bidding documents (standard bidding documents), pre-qualification documents (standard prequalification documents) and procurement contract documents (standard contract documents), and request for proposal documents to be used by the public body to conduct the procurement process. Proposal) to prepare a standardized sample,
(d) To collect data on the procurement action taken or taken place by the public body and monitor or ………… test whether such action is in accordance with this Act or the rules or guidelines made under this Act,
(D1) To review after the purchase (D2) To prepare a record of qualification and experience related to procurement of builders, suppliers, consultants and service providers,
(d3) Issuance of electronic procurement guidelines,
(e) To give opinion advice if a public body requests an opinion consultation in relation to any matter mentioned in this Act or the rules, guidelines made under this Act,
(f) Establishing and operating a procurement related website,
(g) To publish a bulletin to publicize this Act and the rules, guidelines, technical guidelines and public procurement-related articles, materials and other similar matters made under this Act,
(h) To prepare and submit to the Government of Nepal for approval the necessary procedure for coordinating procurement work,
(i) Arrange regular training programs for bidders or employees who are or will be involved in the procurement process,
(j) Release from the black list as per section 63To prepare the necessary standards in relation to and release from the blacklist according to those standards,
(k) To make the procurement system effective, to review and review the construction, supply, consulting services and other service systems and regularly take suggestions from the service recipient or from international organizations and other foreign bodies as needed,
(l) Prepare a plan for domestic or foreign aid necessary to organize and improve the procurement system and act as a central agency for coordinating such aid, (l1) Purchasing experts certifying, conducting,
(D) To submit the annual report of the procurement process to the Government of Nepal, and
(d) Perform other specified tasks.
(2) Notwithstanding anything written in sub-section (1), the Public Procurement Monitoring Office shall not be involved in any manner in the procurement process conducted by public bodies other than its own office or resolve any dispute arising in connection therewith.
(2a) If the procurement action taken by the public body is found to be contrary to this Act or the rules, procedures or guidelines made under this Act, the Public Procurement Monitoring Office shall correct the error in such procurement action and take action against the officials involved in the procurement action in accordance with the prevailing law; and In the event that the head of the public body is involved in such procurement action, he can send a written notice to the authority. In this way, the head of the public agency or the person in charge shall take action against the relevant official in accordance with the law and inform the public procurement monitoring office.
(3) The Public Procurement Monitoring Office shall perform the work of the secretariat of the review committee as per section 48 and arrange the budget required by the said committee.
